The suit was filed before the Civil Judge Senior Division, alleging that the Mosque was built after Lord Vishweshwar’s temple was destroyed by Mughal emperor Aurangzeb.
The Order States,-
“Having regards to complexities involved in civil suit & the sensitivity we are of the view that the suit before the Judge, Varanasi should be tried before a senior and experienced judicial officer of UP Higher Judicial Service. We accordingly order and direct that the Civil Suit before Civil Judge Senior Division Varanasi shall stand transferred to District Judge Varanasi and all interlocutory applications shall stand transferred.“
The Supreme Court while on its hearing said, “We are here in a joint mission to preserve a sense of unification in the country. Once the commission report is there, there cannot be selective leaks. Do not leak things to the press. Only the judge opens the report,”
Stating that a “slightly more mature” and “seasoned hand” should handle the Gyanvapi mosque case, the Supreme Court suggested that the matter be heard by a district court in Varanasi. “A slightly more seasoned and mature hand should hear this case. We’re not making aspersion on the trial judge. But more seasoned hand should deal with this case and it’ll benefit all parties,” the bench said.
Today, Allahabad High Court adjourned the hearing of the Kashi Vishwanath temple-Gyanvapi mosque case till July 6. The HC was hearing a petition challenging the suit pending in the Varanasi court regarding the dispute. As many as six petitions have been filed in the High Court over the matter. The Varanasi court will resume hearing the case on May 23.
