MUMBAI: On Wednesday, the Bombay High Court granted interim bail to BJP leader Kirit Somaiya alleged a case of misappropriation of funds registered by the Mumbai Police.
The bench headed by Justice Bharati Dangre took the decision and asked the council member of the petitioner if the police requires his custody. Senior Advocate Shirish Gupte arguing for the prosecution, tendered a report which stated that there was not enough evidence of misappropriation against Somaiya and his son.
Advocate Shirish Gupta informed the court that custody was not required for now. While asking about the summons he informed them that a notice under Section 41A had already been issued to them. In the event the police wished to take him in custody, Somaiya will be notified 72 hours prior to the arrest, Gupte said.

Somaiya was directed to remain present for interrogation in the office of the Economic Offences Wing (EOW) in Mumbai on August 17.
