Vacation Bench insisted for physical presence of lawyers for arguing cases: Supreme Court

NEW DELHI: A vacation bench of Justices Ajay Rastogi and BV Nagarathna insisted on the physical presence of lawyers for arguing cases instead of making their appearance through video conferencing.

We come to court every day. Only lawyers who are physically present, we’ll give them indulgence,” the bench remarked.

The remarks came in cases after Senior Advocate(s) Mukul Rohatgi, AM Singhvi joined an online hearing. During an online meet the bench said –

“Why should we grant you any indulgence when you are not in court. Others are here during vacations.”

When the bench adjourn the matter, the council member said –

“Please keep it day after tomorrow. I will be in court.”

In another matter wherein Senior Advocate AM Singhvi appeared virtually, the bench said that the vacation was meant not for seniors but for young lawyers.

“Your Lordships may make uniform rule. Let there be no Article 14 exceptions,” Singhvi submitted.

“Vacation is meant not for seniors but only for young lawyers,” the bench remarked while it asked Senior Counsel as to when he could come to court.
